JOURNAL ENTRY OF JUDGMENT ON JURY VERDICT

On February 2, 2009, the above-captioned case came on for trial. The Plaintiff, Neurovasix, Inc (“Neurovasix”), appeared by and through its corporate representative and counsel of record, John E. Howland. The Defendant, Kelly Wayne Buchner (“Buchner”), appeared in person and the Defendant, Microvas Technologies Inc. (“Microvas”), appeared by and through its corporate representative and counsel of record, Steven J. Adams and Robert L. Smith.

This case includes claims and defenses to be tried by the Court, without a jury, as well as claims and defenses to be tried to a jury. On February 2, 2009, the parties announced they were ready to proceed with the trial. A jury trial as to those claims and defenses to be presented to the jury was conducted and completed. Before Trial, Neurovasix filed a written request for proposed findings of fact and conclusions of law for the claims to be decided by the court. Because (1) all claims have not been decided and (2) the Court has not set off against the jury verdicts those recoveries awarded to Neurovasix against Microvas and Buchner in its prior orders on Neurovasix’s motion for summary judgment, this Judgment is not a final judgment as recognized by OKLA. STAT. tit. 12, § 994 and, accordingly, execution may not issue. A final judgment will be entered in connection with the court’s decision on the claims and defenses to be decided by the Court, and after considering pre-judgment and post-judgment interest on the jury verdict judgments, costs, attorney fees if applicable, and any offset rights of Neurovasix.

After hearing all evidence on those claims to be considered by the jury and after receiving the Court’s instructions of applicable law, the jury returned its verdicts in favor of Microvas and Buchner and against Neurovasix. The Court finds that each Jury Verdict Form on each cause of action submitted to the jury was in all respects proper and is accepted by the Court.

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court, based upon the jury verdict, signed by ten (10) of the twelve (12) jurors, on Buchner’s claim for fraud, that judgment is rendered in favor of Kelly Wayne Buchner and against Neurovasix, Inc, in the amount of Seven Hundred Fifty-Five Thousand and no/100ths Dollars ($755,000.00).

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court, based upon the jury verdict, signed by ten (10) of the twelve (12) jurors, on Microvas Technologies, Inc.’s claim for fraud, that judgment is rendered in favor of Microvas Technologies, Inc and against Neurovasix, Inc. in the amount of Three Hundred Forty-One Thousand and no/100ths ($341,000.00).

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court, based upon the jury verdict, signed by eleven (11) of the twelve (12) jurors, on Buchner’s claim for breach of the Consulting Services Agreement, that judgment is rendered in favor of Kelly Wayne Buchner and against Neurovasix, Inc. in the amount of Fifty-Six Thousand and no/100ths ($56,000.00).

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court, based upon the jury verdict, signed by eleven (11) of the twelve (12) jurors, on Neurovasix’s claim for breach of the license agreement contained in March 22, 2005 “Security Agreement,” that judgment is rendered in favor of Microvas Technologies, Inc. and against Neurovasix, Inc.
